In March 2025, the appellate instance reviewed the case, but the sentence remained in force. At the end of 2025, the Supreme Court of the Russian Federation overturned the decision and sent the case for a new trial with the prospect of reclassifying the charge to a more severe article on 'state treason,' which could lead to a significantly harsher punishment.

Borys Serhiyovych Kadochnikov was born on October 26, 1972, and lived in Simferopol. According to information disseminated by the occupation authorities, Kadochnikov was accused of allegedly maintaining contact with a representative of the Security Service of Ukraine through messengers during 2022–2023. The investigation claimed that he agreed to cooperate and carried out specific tasks. One of the main pieces of evidence was the story of receiving and moving SIM cards, whose coordinates, according to the FSB, were transferred to the Ukrainian side.

The case of Borys Kadochnikov was considered by the Russian-controlled Supreme Court of the Republic of Crimea. The trial took place under conditions of the actual absence of independent justice in the occupied territory. Ukraine and international human rights organizations have repeatedly emphasized that criminal prosecutions on politically motivated charges in Crimea do not meet fair trial standards and often rely on dubious evidence or closed case materials.
