Copyright Policy
1. General Provisions
1.1. This Policy sets out the terms of use of materials published on the website Virtual Memory Space. Museum of Crimean Resistance / www.museum-resistance.com (hereinafter — the “Site”), as well as the procedure for contacting us by persons whose copyright or related rights may be infringed by the materials published on the Site.
1.2. The owner of the Site is Sole Proprietor Tevfikova Lera Reshativna, EDRPOU 3176110707, contact address: [email protected] (hereinafter — the “Owner”, “we”).
1.3. This Policy applies in addition to the Site’s Terms of Use and is governed by the Law of Ukraine “On Copyright and Related Rights”, as well as, where applicable, by international treaties in the field of intellectual property.
2. Categories of Materials on the Site
The Site contains various categories of content with different legal statuses:
2.1. Original editorial content — texts, analytical materials, design, and structure of the Site created directly by the Owner.
2.2. Archival materials — photographs, documents, court decisions, protocols obtained from state archives, open registers, or official sources.
2.3. Third-party materials — photographs, videos, texts, and testimonies provided by the families of victims, partner human rights organisations, journalists, or other rights holders.
2.4. Public domain materials — documents and images for which the term of copyright protection has expired, or which by law are not objects of copyright (for example, official documents of public authorities).
The legal status of each material is indicated directly next to it (source, author, rights holder), where this is possible and known.
3. Rights to the Original Content of the Site
3.1. Texts, analytical materials, structure, and design of the Site created by the editorial team are objects of copyright and belong to the Owner, unless otherwise expressly stated.
3.2. Use of these materials is permitted under the terms set out in Section 5 of this Policy.
4. Third-Party Materials
4.1. Materials provided by families, witnesses, and partner organisations (photographs, memoirs, documents) are published with the consent of the relevant persons or within the rights granted to the Owner for their use.
4.2. Rights to such materials remain with their authors or rights holders, unless otherwise agreed in a separate agreement. Publication on the Site does not mean the transfer of rights to the Owner, except for the rights to post and non-commercially distribute them within the purposes of the Site.
4.3. Questions regarding further use of such materials (reprinting, commercial use, modification) should be agreed directly with the rights holder. Where possible, we will assist in contacting the rights holder upon request.
5. Terms of Use of Site Materials by Visitors
5.1. Materials of the Site, the copyright to which belongs to the Owner, may be copied, quoted, and distributed provided that:
- the source is indicated with an active link to the Site;
- use is exclusively for non-commercial, educational, scientific, or human rights purposes;
- the integrity and context of the material are preserved without distortion of its content.
5.2. It is prohibited:
- to use the materials for commercial purposes without the written permission of the Owner;
- to modify archival photographs, documents, or testimonies (collage, montage, editing) without written consent;
- to use the materials in a way that distorts historical facts, diminishes the significance of persecution, or is used for propagandistic purposes;
- mass automated copying (scraping) of Site content without prior agreement.
5.3. For third-party materials (Section 4), the Owner’s permission for non-commercial quotation does not replace the need to respect the rights of the original rights holder; in case of doubt as to the scope of permitted actions, please contact [email protected].
6. Licence
Original textual materials of the Site are distributed under the Creative Commons Attribution-NonCommercial-NoDerivatives 4.0 (CC BY-NC-ND 4.0) licence, unless otherwise indicated next to a specific material.
This means that the material may be copied and distributed with attribution, without commercial use and without making changes.
Archival materials and third-party materials (Section 4) are not covered by this licence — their legal status is determined separately, as indicated next to each material.
7. Procedure for Notices of Rights Infringement (Notice-and-Takedown)
7.1. If you are the rights holder of material published on the Site without proper permission, or believe that your copyright or related rights have been infringed, please send a notice to [email protected], indicating:
- a link to the material (page URL);
- a description of the material and your rights to it;
- contact details for communication;
- confirmation of the good faith of the notice.
7.2. We will consider the notice within 40 business days of receipt.
7.3. If there are sufficient grounds, we will temporarily restrict access to the material for the period of clarification of the circumstances, or remove/amend the material (for example, add correct attribution) based on the results of the review.
7.4. If the notice turns out to be unfounded or abusive (for example, aimed at concealing historical facts of persecution), we reserve the right to refuse to satisfy the request, providing justification.
8. Specifics of Materials about Political Prisoners
8.1. The publication of names, photographs, and documents of persons who have suffered political persecution is carried out in the public interest for the purpose of preserving historical memory and protecting human rights.
8.2. Issues relating to content concerning a specific person (and not issues of copyright in the material itself) are regulated separately — please refer to the section “Personal Data of Persons Mentioned on the Site” in the Site’s Terms of Use.
9. Changes to the Policy
We may periodically update this Policy. The current version is published on this page with an indication of the update date.
